Please Sir,
Suggest me how the defence may be benefited, if damaged car is not made case property and not produced in court neither released from court nor from police station. Suggest the provision or citation in defence.

u mean to the case property is not seized there is no case at all.

It'll certainly beneficial for the defence...... its difficult for the prosecution to prove his case without the actual damage shown in offences of mis chief
