Querist : Anonymous (Querist) 09 July 2010 This query is : Resolved
Dear Daksh,

Many thanks for your quick reply. Truely appreciate it. This is about my friend who was a partner for manufacturing company.

They had some misunderstanding which led to the other partner in lodging a complaint against my friend and his associate ( he has lodged the complaint saying he and his friends have been involved in cheating case). All I need to know is wat is the lead time taken to get a bail under cheating category.

Very worried abt their bail.

Regards,

Dear Anonymous,

If you see the ingredients of Section 420 then there has to be a trust imposition and subsequent intentional commitment of breach of the same. The facts enumerated by you say and suggest that being in close proximity it is only a matter of communication gap and at the most it could be a civil matter on which basis the request for the bail could be made specifically mentioning of the fact that the accused will be duty bound to join the investigation as and when called for.
Best Regards

Daksh

Hi Daksh,

But the warrant has already been issued and the cops are looking for these guys. They are absconding from past 20 days. So wat is the lead time for the Bail generally? or does it vary from case to case?

My questions might sound silly, but i don't hv any knowledge on these matters at all.

ii. Go to High court and seeking writ that matter is pertain to civil nature and request to queash the complaint.
