EXTRA JUDICIAL CONFESSION

A complainant who complained to cbi in the mattter of corruption.

IN HIS COMPLAINT HE STATED THAT HE MET TWO GOVT EMPLOYEES ALONGWITH HIS ATTORNEY AND THEY DEMANDED FROM HIM A BRIBE.
IN HIS STATEMEENT GIVEN TO CBI SUBSEQUENTLY HE STATED THAT HIS ATTORNEY SPOKE TO THE GOVT EMPLOYEES IN REGIONAL LANGUAGE AND HE CONVEYED IT TO ME.

EXTRA JUDICIAL CONFESSION

IN THE MEDIA AND PRESS INTERVIEWS HE STQATED ANOTHER ATTORNEY NAMED SINGH SP0KE TO THOSE GOVT EMPLOYEES IN A REGIONAL LANGUAGE AND SINGH SAID DEAL IS FINALSIED
IN ANOTHER PRESS REPORT HE SAID: SINGH DEMANDED MONEY IN FRONT OF THOSE GOVT SERVANTS
I WANT TO KNOW WHETHER THIS EXTRA JUDICIAL CONFESSION CAN BE TAKEN AS AN EVIDENCE IN A COURT . SINCE HE IS TOTALLY LYING AND CANNOT EVEN SAY CORRECTLY WHO DEMANDED MONEY FROM HIM

extra judicial confession is a very weak type of evidence,it should be taken into consideration when during trial other witness corroborates the same story and the person who is making the confession must have to make without any external undue influence force or fraud.when the complainant himself making the contradictory statement,and if the same is reflected during trial, its very much unsafe to place any reliance over that extra-judicial confession.

How C.B.I. can entertain any matter for investigation without direction of C.M./P.M./President of India/Governer of any state/High Court/Supreme Court.Otherwise also an extra-judicial confession is a very weak evidence.
