This query is : Resolved
Hello,
My senario is similar to the one mentioned in the below link. http://www.lawyersclubindia.com/experts/Urgent-mother-alias-name-printed-in-my-birth-certificate-and-needed-for-passport-402456.asp
birth certificate has incorrect father's name. Registered name is Chockalingam. Birth certificate has Rameshkumar(Alias name called at home. We dont have any legal document with this name)
We have appilled for Gazette notification and news paper and submitted passport application. But the issuing authority has denied asking for id proofs for old and new names. Since old name is a alias name we do not have a id proof.
Kindly suggest an solution. desperately seeking for advice. Please help.

You can ask the Authorities to receive an Affidavit from you stating that both the names belong to one and the same person. Make all your applications in both names as "alias" i.e. xyz @ abc

Many thanks for your reply. Yes.. we submitted an affidavit mentioning the same form an nortory.. stil the passport issueing authority is not granting passport. He is expecting the birth certificate to be changed. When asked at corporation they say gazeete is enough for passport. And not accepting for name change in birthcertificate.

With the Evidences of your actual Father's name approach an Advocate and request him to file a Declaration Suit in the Court.Once the procedures are completed the Court will give Directions for necessary rectifications and the pass port office would oblige. The Court formalities could be completed in 30 days.Consult a Lawyer

Yes as advised by experts, if nothing works out, a decree of declaration suit declaring the said name will be the only solution.
