Freedom of speech and expression

Querist : Anonymous (Querist) 29 April 2011 This query is : Resolved
Our apartment, the people who manage the funds for the daily activities are mismanaging the money and when I question this, they removed me from the meetings, it is like if someone questions anything, they get killed in British rule. So, there is no forum for me to express my questions or respond to their wrongdoings, can I put some cartoons in the apartment notice board against them? Are there any legal issues involved in this? As per our constitution, can I not have the freedom of speech and freedom of expression?

Is that defamation case given to the police station, or they directly go to the court? Can I not move against them in the court? What are the implications? Does it come under Civil law or criminal law?

What if I don't use their names? Just the symbolic persons?

its better not to create nuisance.

if you have any grouse against the other party and your rights are being violated then you have civil remedy.

its advisable not to perform Munna Bhai kind of act in practical life....practical life has different principles.

seek justice in court if any of your rights are being violated.

Dear Anonymous Member,
Your query is about the mismanagement of the money by the people of your apartment and upon your raising voice they barred you from meetings.

Now if the money in question is their own heard earned money then why are you or anyone else be bothered about it's use however if it's the money of your apartments Co-operative Housing Society or RWA then it's obligatory on your part to report it in writing to the Chairman of your Apartments RWA/Co.Op.

If no satisfactory reply then report the matter with all the relevant facts to prove you allegation to the local Police as well as to the Registrar of the Housing Society of your town/municipal area.

@ Expert : M.Sheik Mohammed Ali - Be more elaborate about the defamation aspect please.

Dear member

Whatever you are telling against anybody, just think before you tell. Because it is not important what the speaker meant but sure it is important what the listener understood. An interesting story will justify this as follows:
Ranjit Singh was travelling in a crowded bus. He was carrying the passport-size photograph of his son for college admission.

Accidentally, the photograph dropped down from his pocket.

He started searching for it frantically & found it on the floor below the ends of a woman's saree.

He asked her, "Can you lift your saree? I wanna take photograph"....

THE REST IS HISTORY....

He was beaten so badly that he had to be admitted to hospital. He was surprised to see Jaswant Singh on the next bed to him in a worse condition.

Jaswant explained what happened to him.

He had gone to a remote village to work. He finished late & missed the last bus. He couldn't find any hotel nearby.

So he approached a nearby house & asked the owner whether he can stay there for a night.

The owner replied "I have 2 grown-up daughters. Sorry, you can't stay here."

Then he approached the next house & asked the owner whether he can stay there for a night.

The owner too replied "I have 3 grown-up daughters. Sorry u can't stay here."

So he went to the next house & asked "Do you have grown-up daughters?"

The owner asked "Why?" and Jaswant replied, "I want to stay for a night."

THE REST IS HISTORY... boommmmm..!!!

The moral of the story is:

WORDS GET YOU INTO DEEP TROUBLE IF YOU DON'T USE THEM CORRECTLY
