I have made a French window in my hall.
I want to know what actions can the society take to get it restored and how can i protect myself from it.
Application to the society for making the french window stands un-replied for 38 days now. According to Rule 65 they should have replied within 15 days.
Also is making a French window a structural change on a R C C pardi wall. Structural Engineer has certified it being safe to remove the same (no damage to the building)

Contact local lawyer who can understand the conotation like "French Window", "under Rule 65" which rule you are referring?.

your agreement for purchase of property from builder must be containing a clause that external facade would be maintained by you . it appears you have made a french window without society permission . society can issue notice to restore window to original condition failing which society can move cooperative court against you

Society not replying you so far may amount to no contest from its side.That does not mean it agrees with you. Responsibility is on you to justify you have done nothing wrong. Wait for written reply from society

If the change in the external look of the apartment has been done without the permission of the society, you may have to remove it once objected, what is the bye law terming it?, Please make sure that you are not violating the provisions of law in this respect by your such act.

Despite the fact that the author has not mentioned about the Bye-Laws of the Society, legally, author has no right to change the external face of the Society, it is implied.

1. The Society is ONLY a "service provider", for providing "common services and amenties" AND has no say on any internal alterations made by any Flat-Owner alias Member. The Society has no jurisdiction on taking any action or imposing fines or regularising any alterations etc.... (refer Society bye law no. 175 (in Maharashtra)
2. However, IF any Society member violates any criteria of building plans, THEN the role of the Society is restricted and limited to duly informing the local Municipal Authorities about violations and action.
