get property of my Deceased mother

my mother had purchased a shop in 2003 after that she died in 2005 and did not make any will. As I am the only daughter of my mother I want to get back my mother property from my maternal uncle possesion. I have death certificate of my mother and certified registry of that property. Now what a easy and fast procedure to get my mother property back. My father and mother already got seprated long ago. After that my mother purchased it. So kindly show me the way what to do.

It is believed that Hindu Succession laws are applicable in your case.


The absolute/self acquired property of deceased Hindu woman devolves upon her husband and sons and daughters.



If there was no judicial separation ( divorce) between your mother and father then your father and you have equal share.



You may approach the authority under whose jurisdiction property falls and inquire about requisite forms, procedure.


You may have to present the death certificate, Legal heir certificate/affidavit etc..................and authority may ask to release newspaper advt., if any, as per the procedure.



Try amicable with your uncle to vacate the shop.


If amicable settlement does not fetch any desired result approach a very able counsel specializing in such/property/civil matters with all docs on record and proceed further under expert advise of your counsel.
