my mother has land in rajasthan and she want this land to gift my son .what kind of legal document required to gift this land.and should i have to pay stamp duty? iwant my son name in govt. records.please advice me

Ask your mother to execute a gift deed in favour of your son and get it registered. With this document you'll be able to transfer the ownership of the land in the name of your son in the govt. records.

ift-deed shall be drafted on stamp duty/papers and registration charges shall also have to be borne and thereafter revenue authorities shall enter Intkal (mutation of gift) in favour of donee i.e. your son.

Gift Deed may be executed by your mother to your son. You need to look into Rajasthan Stamp Act for stamp duty. In Karnataka stamp duty for gift deed is Rs. 1,000/- and registration charge of Rs. 500/-. Contact your local registration office to find out exact stamp duty and registration charges applicable for gift deed for family members.

I think nobody is correct in advising, first of all we are LAWYERS, we ought to know that what will happen in future.We should the Author for clear clarification. All of them told that yes Gift Deed has be registered. But nobody asked whether Gift property is her self-acquired or ancestral, in case self-acquired there is no impediment to Gift the property. In case it is ancestral property how she will Gift the property (subject to her portion, she can gift only her portion).
