Gratuity payment

Hello Experts,

I got a question regarding Gratuity . One of my friend working who is working for a US based company in Bangalore is now serving his notice period .He was associated with the US based company for 3.5 years and the same company was acquired by a UK based company a year ago .

Is he entitled to claim Gratuity ?

As per Gratuity Act an employee shall work a minimum period of 5 years. (4 years and 240 days will be treated as 5years). consult a local advocate for any issue.

Why you are so much concerned about the academic question qua entitlement of your "friend" employee serving notice period after 3.5 years service of US company taken over by UK based company?
