Hindu Duahgter converted to Muslim after marriage and her right on Hindu Father's ancestral property

1. Hindu Father has ancestral property
2. Hindu Daughter converts to Muslim

Will the Daughter inherit ancestral property under HINDU law or MUSLIM law ?

Instead of academic question, you could better have given description of the real problem, if there is any, and discussed how you are concerned with that.

Okey Here is a full fact.

Father has an ancestral property and living with a son and Daughter.

Daughter gets married to muslim

Daughter's husband dies and she becomes a widow.

Now, the Daughter has 2 sons and is threateting her father and brother.. saying that she will file a suite for her share in ancestral property.

Father has no will/gift yet.

How can Father and Son be prepared.

Please let me know, if you need more details.

She can not claim.
alexander (Expert) 25 December 2015
You have proof of her conversion to Muslim religion e.g the copy of the Nikah Nama. As she converted to Muslim faith after her wedding her marriage must have been performed under the Special Marriage act

2. On conversion to any other religion she ( Muslim religion in the instant case) she is not entitled to your properties/ estate. She cannot legally claim them.

You can make a Registered Will in favour of any body you like. or you may even gift your property to whomsoever you want to give them

Will involves no stamp papers and duties. Gift deed shall have to be on a stamp paper of proper value depending the worth of yoye estate.

You may better consult an able counsel specializing in family/revenue/property/civil matters with all record and your counsel can guide you further including if you are a convert now.

I go with the expert Sri Alexander.
Sudhir Kumar, Advocate Online (Expert) 31 December 2015
Agreeing with Mr Alexander, I would clarify that

"marriage with Muslim"

and
"conversion to Islam"

are two different events.

You have nowhere stated about her conversion.

You feel sorry for not adding details, but still you have not added background detail of the problem.

The question arises, how you are concerned with the problem of the converted daughter from Hindu to Muslim?
T. Kalaiselvan, Advocate (Expert) 03 January 2016
The details of property and the situation is to be known to give a proper opinion to this issue.
In my opinion the coparcenary rights may not be affected due t conversion, but let me check that on getting a reply from the author in furtherance.
Guest (Expert) 03 January 2016
You have also not mentioned how you are concerned with the problem, as it does not seem to be your own problem.
Kumar Doab (Expert) 03 January 2016
You may better consult an able counsel specializing in family/revenue/property/civil matters with all record and your counsel can guide you further including if you are a convert now and of your children.

even the paid lawyer will call for facts and only then will open mouth.
