How safe to buy a inam land in bangalore?

Hi,

I found a Gated Community Layout in Horamavu(Kalkere)and liked a plot in it. When I got the documents for legal verification I found that it was a Inam Land and the brief details is as below:

1. Order in LRF case No. 101/1956-57 for Sy. No xyz measuring N acres in the name of ABC (wherein ABC was declared as permanent occupant). --> executed in 1958.

2. Endorsement isued by Special DC under Inam Abolition Act for Sy No. xyz meaasuring N acres in the name of ABC. --> executed in 1964.

3. Endorsement issued by Tahasiladr stating Sy.No. xyz measuring N acres doesn't come under sec 1, 7, 7A of Land Reforms Act. --> executed in 2011.

4. Endorsement issued by Tahasiladr stating there are no cases under PTCL Act.


Rest all documents looks clear (DC converted, A-khatha, EC, RTC, Layout Approval etc..)

Please help to suggest whether it is safe to buy a plot here?

Facts reveal that the land is covered by the Inam Abolition Act. It is no longer of the alienated tenure and the holder is not an Inamdar, but an occupant. An occupant is entitled to transfer the land unless other wise prohibited by law.

Once the layout is formed and plots are made, it is deemed that the land is clear land. The authority before giving permission for layout will check up all the required formalities such as title of the land, payment of fee by the permanent tenant (for ORC) etc. So, there is no need to worry as the layout has been sanctioned by the authority. But you should check up and clarify the layout number in the concerned authority who given permission for the layout i.e. whether it is a genuine layout or the builder who created the layout had made a fake layout.

By seeing the facts I can understand that earlier it was Inaam land. Later, the cultivator who has been cultivating the crop for a long time (declared as permanent tenant) has been allotted ORC (Occupancy Rights Certificate). That is the permanent tenant has become the owner of the land. Basing on this layout has been formed. So, the title will be clear.
