Everything depends upon the terms and conditions in the agreement. If there is any clause of forfeiting the margin amount in case you back out from the agreement, then he has the right to forfeit the money. The owner cannot sell/lease/rent the flat to anyone else without cancelling this sale ageement.

I do agree with Archana. Whether possession of the property is handed to you or not, if not then issue a notice of cancellation of agreement of sale and refund your token money within __ days , if owner didn't responded then file a suit for recovery of money, no other way.

It all depends upon the terms and conditions of the sale agreement which was signed by you......if there is an provision of forfeiture of that money then u cant claim the same, so go through the terms of the agreement and contact a good lawyer to get your money back.
