Husband claiming Share in Wife's self-earned Property

Querist : Anonymous (Querist) 06 May 2011 This query is : Resolved
DearSirs,

Does a husband owning 1.5 Hectare of land and patta in his name is eligible to claim a share from his wife's self-earned 2.5 Hectare property along with his 4 Daughters and a Son?

If so what is the maximum percentage he can get?

Whether his Son-in-laws can file a case against him, if he had forcibly made his Son and daughters to transfer the entire property to him by the way of a sham partition deed registered.

Thanking you in-advance.

If it is a self earned property, then nobody (including husband, children, parents etc.) can claim/demand any share in the property. Even if the husband/children do not have any land / property of their own, still also they cannot claim any share from anybody's personal / self-earned property.

You are also taking about some partitions (sham partition). Unless you give the details of the partition, and when was it done, who did it, what was the property which was partitioned, and who was the property before the same was partitioned etc., it will not be possible to give any comments on your queries.
