A well settled law that mentioning of a wrong provision, or non mentioning of any provision of law would, by itself be not sufficient to take away the jurisdiction of a court if it is otherwise vested in it in law- It was held by Sc in it's recent two judgments decided on 12.02.2009 and 23.07.2009. then how can it be a ground of rejection?

Go through the para 14 of J. Kumardarshan Nair V/S Iris sohan & others, and para 13 of P.K.Palanisamy V/S N. Arumugham.
