always start filing case from lower court in your case i dont understand how can u file coplaint in high court under writ pettion. the proper remedy to file complaint to police then superior authority of police and then magistrate.

What writ has been sought in your petition from High Court?

Whether the subject matter of writ and cheating are different or same?

What is the opinion and advise of your lawyer, if it is a true story/query?

Why do you need second opinion for the story/query, if the story/query is true, except the fact that it is FREE OF COST on this platform? If you have lost faith in your lawyer change him/her immediately.

Without knowing / referring full case file and details / material facts/ related documents, nothing can be advised. Discuss with your lawyer.

Come out with full facts about the case.
Dr J C Vashista (Expert) 18 April 2017
These are two different cause of action, you may proceed to file a case of cheating.

Discuss with your lawyer who is well equipped with all the facts and circumstances of the case(s) and competent enough to decide, guide and proceed.
P. Venu (Expert) 18 April 2017
please disclose the complete facts.
