Industrial Unit in RIICO- Bhiwadi-Rajasthan

I am NRO living in Kuwait sine many years. I applied and got a NRI quota Industrial Unit- Plot of land for a factory in RIICO- Bhiwadi. I paid full payment for the plot a few years ago. As per terms I was supposed to finish construction and show production from factory. I did not construct nor show any production. RIICO penalised me for the delay and gave me 45 days time to construct and show production from factory.

My query is " how can I obtain resonable time to construct and show factory with production of AUTO parts.

as I am living in Kuwait and a heart patient, I need advise on how to avoid the cancellation of the PLot as threatened by RIICO.

I await good advise and help in this matter. I will come to Delhi and RIICO in january 2010.

First of all, it has to be seen the allotment letter and the provisions of the agreement reached between you and RIICO, while allotment was done. If the provisions give any scope to carve out grounds for you to challenge the cancellation of allotment, even in failure of completion of industrial unnit and its production, those grounds have to be raised in the representation to be given to the RIICO, seeking some more time for setting up the industrial unit. If the RIICo won't consider your representation, then you have to move high court against any letter to be issued by RIICO cancelling the allotment. Naturally, in the writ case before high court you will show your poor health and economic slow down and unexpected financial difficulties for not setting up the industrial unit within the stipulated time and seek from the High Court a direction to RIICO to extend reasonable time for completion of the project.

You should contact the RICCO office at Bhiwari and tell them about all problems and give them a letter to give u a reasonable time, i am sure they will do it. One of my friend had same problem but we settle that in same procedure, you will have to pay some fine only. In case of need of any help u can contact on my e-mail.
