insurance claim for accident by the pillion rider

Sir I got an accident with my bike in which my boss who was the pillion rider got injured now his advocate make allegation on me that I was driving with excessive speed. while I record a FIR that some unknown vehicle hit us from back side. I have a comprehensive insurance policy of my bike. kindly suggest me if court pass a claim then who will bear it my insurance company or me

Have you informed your insurance company and sent the copy of FIR to them. In case any suit for damages is filed insurance company is necessary party and will have to pay claim

In this regard I have received a court notice in which the pillion rider who was on my bike at the time of accident file a composite negligence case against me and my insurance company. because i was the driver of same vehicle i would like to ask that who will pay the compensation me or my insurance company

Seems to be purely a hypothetical query.

When you obliged your boss by giving her a free ride, can't you ask him why he filed a case against your or not request him to withdraw the case?

I am sure that your Boss filed the case with your clear knowledge and full support too, so as to get compensation from the Insurance Company and now you wants to know consequences that may arise to you. As you have comprhensive insurance cover, and the insurance company is made a party to the proceedings, prima facie, it is felt that the Insurance Company will have to bear the liabulity.
