Interim Maintenance

I am filed maintenance application and claim maintenance of Rs. 4000/- p.m.

Now I want to file interim application

My question is that what amount shall I mentioned in such application whether to mention Rs. 4000/- or less...

what the law requires

pls. provide citation...

You should pray for the same amount.

You can claim any amount which does not exceed the amount as mentioned in the main petition.In your case any amount up to Rs.4000.

You have already filed a criminal miscelleneous case petition praying maintenance of Rs.4000/= hence your interrium application should be for Rs.4000/-

interim application for maintenance is an interim application for giving immediate relief in respect of litigation expenses and the expenses required for monthly expenses . under section 125 Cr P c the interim application to be decided within 60 days from its filing .
