I booked a ticket from Allahabad to Howarah in the month of december and due to any reason train was cancelled on the day of journey and It was important to go there hence I managed to go with another train.In the mean while I talked to the customer care executive about the cancellation of the train she told me to drop a mail with your registered e-mail id to irctc and ask them to cancel the ticket.I sent a mail to them without informing pnr detail etc.3 days I checked my mail and irctc wrote me as you have not registered for TDR so we can not refund you. I think it is cheating because they can cancel my ticket automatically as in case of wait list ticket they do and can refund in my account.Now they are saying they are bound with the rules and regulations.In the era of consumerism how they can show their irresponsible behavior towards their customers? What should I do? Am I guilty? I am feeling cheated.

If the train is marked as "CANCELLED" in PRS due to breaches, floods, accidents etc. full refund is permissible in case the E-ticket is cancelled within three days of the scheduled departure of the train. In case of e-tickets, such cancellations can be done by the customer through Internet.
The above rules of Indian Railways are subject to change without prior notice.

So in law you shall be deemed to have agreed to this rule of cancellation ,the soon you booked your ticket and can not blame them for deficiency in service .

I am very much thankful to both the experts Mr.P.S.Dhingra and Mr.Prabhakar Singh.But still i m not satisfied what Mr.Singh has said.My simple points are:

1. IRCTC was aware about the the cancellation of the train, then why they have not cancelled the ticket and refunded the amount. They can do it.

2. Being a customer of IRCTC, why they are not providing services as proper information about such issues.as they can also send a message to their customer nos so they can do further things.

3.IRCTC is asking for filing for TDR withing 72 Hrs.Why customer care executive had not informed me this issue when I called her just after knowing the train is canceled.

4.There are thousands of customers who are being cheated of mislead by these agencies because hardly few of the customer bother about it.Why the things are not so transparent.

5.If the service provider has not rendered their services then why a customer should be charged in this case by showing faulty policies of Indian railways/IRCTC.

6.If I have to cancel my ticket as in case of window ticket then what is the role of IRCTC data base management and other online stuff.Are they simply a broker or agent of Indian railway. A customer should not expect any other services or comfort, is it the case?

7. Do a customer must have a Ph.D in the rules and regulation of Indian railway and IRCTC before he is going to get any services from all these.

8.It is prepaid services and customer have to suffer the loss.or Indian railway and IRCTC are enjoying their monopoly in the market.
9.I lost around Rs.450 luckily the ticket was for sleeper class.I dont know in which account they show such amount. I am sure it is not a profit of indian railways.

According to me IRCTC should have cancelled all the tickets for all the passengers for the cancelled train and should also apologize for the inconvenience.It can be possible for irctc. Things should be changed because there are many who can not afford such losses.

Your concern is quite genuine. But the irctc is just a media between the passenger and railways for the purpose of reservation of seats. The relation between the Indian Rilways is just like a principal employer and a contractual commission agent. So far as I understand, the irctc does not enjoy the authority to automatically cancel the tickets on cancellation of trains. The irctc can cancel the tickets prior to preparation of reservation chart of the current trains. After cancellation or departure of the trains they simply forward the TDR cases to the commercial department of the railways for refund. Of course, due to cancellation of train your refund should not be denied by railways. Since three days already seemed to have passed for preferring claim through irctc that is why I suggested you to approach the consumer forum on account of decline of your claim. However, it would be better if you prefer claim directly with the commercial manager of the concerned railway and only then approach the consumer forum, if your claim is again denied. But if you file your case with the forum, you must make both the railways and the irctc as party to the case.

Even if you try to enumerate lakhs of grounds to blame them,you shall not succeed
unless you succeed in proving that they had no power to make such a rule of cancellation.
You can not plead ignorance of the rule as law imposes a deemed knowledge.

Why a law is so and not like this or that is not the domain of courts and Fora dealing causes.
In my duty i was expected to express my personal view over your query,that i have done.
HOWEVER THE SAME IS NOT BINDING ON YOU OR SOME ONE ELSE.

MY friend,

In case of the train is cancelled for that day, U have to file TDR online within 72 hrs from the time of departure of the scheduled train or the ticket can be cancelled online within 24hrs. This is mentioned in the TDR manual of IRCTC.
