Dear Experts,
My father has purchased a house of rupees 18 lacs in 2011,got registered on his name.i have given a cheque of 6 lacs rupees for purchase of that property.as I told in my last query , my father debarred me from all the legal rights. So I file the case against him for the share equal to the money given to him for the purchase of said property.Rest 12 lacs rupees for purchase the house paid by loan taken from central bank . My father is paying EMI from the family Pension which he is getting after the death of my mother.
My query is that rest part of the property is consider self earned property or not. I can claim for rest part of property or not.

Case for recovery of amount which my father taken as a family Pension on the basis of false affidavits not to marry again etc. I just want to stop him from selling the property till the judgement of recovery case. I didn't get stay from court till date for the case of my part in above said property. He is free to sale it.

The pension is self acquired. So far suit for recovery is concerned, you need to apprise the court to attach the property as the same is the only property against which the prospective decree can be got executed. Get stay order accordingly.

Have you contributed Rs. 6 lacs or 5.5 lacs? Your earlier queries state, you contributed 5.5 lacs and now in the present query 6 lacs. Any reason for difference in your more than two statements?
