Land and house property purchased from joint income of family members in the name of elder brother

Sir, please guide me on the following issue:

Agricultural Land and House Property was purchased jointly from the income of family members in the name of elder brother of the family in a village in the Maharashtra State as per the general traditions in the joint family. Only name of elder brother appears in records of the land and house property. However, all family members are living in the said house property and were cultivating the said land property till date from its purchase. Now the elder brother, without giving share in the said property to other brothers wants to sell the agricultural land.
Please guide on the rights and entitlement of other brothers. What steps they should take to get their share in the property purchased jointly from the income of all family members.

The property belongs to all the jointees. You can file a suit for partition.

It is a common property, even if it is in the name of your brother, because the property was bought from the common fund.
