Land dispute

sir i am having a land of 1 bigha from which 5 biswah is of another person. we both have taken this land from another person, we made a house road side of land. in front of road the land is 72 feets.our house is near about 10 year old.
the pather is asking for 1 biswah of land in front side of road about of 36feet.
i want to ask according to law how much front he can have. i think 18 feets.
there is nothing about it in registory.

he is demanding wrongly.

he has only 05 bishwa and the front on road is only 72ft. then how can he claim 36ft,the half. equitably he can not ask even for 10feeton road.

Proportionate allocation is legally accepted way if no specific contract is made rest depends upon your mutual understanding.

Actually sir we are trying to solve the issue but he is not agree with it.
we said that we are giving you 1 biswah, the real seller of land is also giving one biswah so that he can use it as a road but he is also not agreeing with it. He dont want it at the corner.
Actually he is a property dealer and he said that i want the land in front of your house near the road. we are not agreeing with it because we can use our remainning land if he takes 36 feet in front of our house. our house is not passed by the MDDA(masooriee dehradun development authority) because it did not come under MDDA and land is in Village(gramin) Area,its not under nagar nigam.
plz tell me how much front side of road we can have according to law. Can we do the foundation in square shape with front of road side near about 52 feets.
please give a best advice.

we are not agree with it because we cannot use our remainning land if he takes 36 feet in front of our house. it is totally waistage of our land, but if he will take only 18feet near it is also waistage of his land but he will get the road at this case.

please tell me how land is divided into proportion if there is only 72 feet near road.(But according to civil law)
