Land purchased but not registered

(Querist) 18 September 2016 This query is : Resolved 
Sir I am ST and I have purchased land from ST but he has not taken permission from revenue deptt and sold to me and we prepared will in court that that this land is given to me as donation from seller .now when I went to tahsil office to register my name.they are telling it is not possible to register. And now seller also expired .what I will do sir kindly help me

Tehsildar cannot refuse to enter mutation on the basis of alleged will even though the same is liable to be challenged by legal heirs of such seller at later stage but Tehsildar cannot refuse on that ground. File an appeal before collector against that order.

Take the help of some local lawyer to get the property registered in your name, if will is not illegal.

Mutation should have been done. If Tehsildar is raising objections, take help of local lawyer.

For transfer of land from ST to ST, prior permission is required, However, get it regularized by applying to District Collector subject to depositing penalty imposed by Revenue Auth.

Whole transaction need revitalization under your state land revenue code or any other state law if any applicable.

Legal process they will ask to pay to Treasury amount in heading of penalty , revitalization fee etc. Additionally you need proper caste certificate etc.

It will take few months time , advocate dealing in land matter can help you.
