Leave and license agreement- for office

Dear Expert, we are taking office on lease for 3 years in Mumbai whose owners are Father (80 Years) & Son ( Lives in Canada ), since the one of the Owner is not in India can we get the registered agreement done with the Father alone, please advise

As there are two owners, the other owner who is in India has to get a POA deed in his favor to let out the property on lease/rent on his behalf too otherwise the registered lease agreement also can be held as invalid because the lessor has defective title i.e., does not have title over the entire property

No. The son who is in Canada shall give a POA to his father in India and the POA to lease the property shall be attested by the Notary Public/Consulate/Embassy of Canada. After receipt in India, the father can get the validation of the POA from the District Registrar, Mumbai. Then the father can execute the lease deed in his capacity and on behalf of his son.
