Legal advice on temple

Sir,
I need an advice regarding peaceful living in temple. Actually we are living in a temple from last 40 year. Temple is located in MCD colony with large space, we are not paying any rent to stay their, also paying on maintenance & renovation of temple & all other expense like electricity.

The matter is some good or bad people in our colony create problem from time to time, fight with us, stand their vehicle on the front gate, smoking, drinking in temple boundaries etc.

When we try to stop them, they says you have no right here just get out, usually they meeting a lot regarding temple issue. What is the solution, how can we live their peacefully, should we make some kind of legal entity document.

Please suggest the right advice, Hoping for any right & helpful advice

you dont have ownership rights in respect of land belonging to the temple . at most you have been acting as caretaker . how did you gain posession ? since the land on which temple stands must have appreciated every one wants a share of the pie . you can as caretaker lodge police complaint against rowdies who are creating nuisance within temple boundaries . you cant smoke , drink in temple premises .

It shall be good if a managing committee is formed with your help for the management of that temple and if a trust can be created or a society is duly registered then its actions shall become legal in nature. You can get the status of caretaker or manager as per resolution of that trust or society and thereafter can take all legal actions as suggested.

An application u/s 92 of the C.P.C can be moved in the Court of District Judge pleading the temple to be public and applicants to be beneficiary for framing scheme of administration.Any two of you can file such application with application of grant of leave to proceed.
