Legal heir certificate................

Respected sir,
We have one agriculture land in my own village. But this land patta is our grandmother name. Grandmother legal heir is totally eight members. Now seven members has expired, one member is alive ( my father only ). My father requested to VAO for change of patta name like this. But vao asked grandmother death certificate and legal heir certificate also. We got grandmother death certificate from court.
Now VAO saying you have to get legal heir certificate from court, after that I will change of patta like this.
Questions:
1. How I get patta for this land?
2. Will Court give a legal heir certificate?

Legal heir certificate is issued by Tehsildar/SDM of tehsil of village.Apply with affidavit stating date of death(along with death certificate) and right in which you claim to be a legal heir.
Engage a revenue practitioner .

The court wont give death certificate. Generally death certificate will be issued by the Births & Death Registrar(MCH/GHMC) only. You have to obtain legal heir certificate from your MRO Office. It is sufficient. If your MRO refuses to give Legal Heir Certificate, then approach a court. The court will give Legal Heir Certificate. But it is a long procedure, when compared to obtain from MRO. After Legal Heir Certificate only, you have to approach MRO for mutation proceedings.

When you claim other seven legal heirs have expired what about their family members .The rights of the deceased would be automatically entitled to their family members. Please make it sure if you are going to change the sole ownership to your father ignoring the rights of heirs of deceased legal heirs you are making your father entitled for committing an offence.
