3. Whether an arrested person can be detained by Police Officer for 24 hours even if his detention for interrogation and investigation is not essential at the time of arrest even for a moment in the given facts and circumstances ?

No person arrested should be detained in police custody for more than 24 hours unless there is a sufficient reason for it ( Section 57), journey period from the place of arrest to Magistrate’s Court is excluded for the purpose of computing this period of 24 hours.

A person can only be arrested if circumstances matched as given in section 41 of Code of criminal procedure code..
