Respected Experts ; I have filed 125 by saying that my husband is. earning 40 K PM . I m graduate and non working and my 2nd child of 6 moths is with me . My husband has replied that he is earning 8 to 10 K . He is running a stationery and photo stateshop in a college. He is not filimg ITR . He is living on rent 3 K with his monther and our elder son of 3 year. He is paying the shop rent of Rs 4K . Now my query id how I can proove his income ? In above said situation how much maintenamca I can expect.

Bring witness to corroborate these statements. You should get at at lest Rs 7-8 thousand.

Dear Sir , I m having the current rent deed copy of shop but not of residence. Shop rent deed showing 4K rent + Electricity bill extra as per meter readings. Is it sufficient or there is any other way to prove ? He is replying that he is doing the photo state only. He has not disclosed the stationery business .

you should proove your husband earning 40k PM, than only you can claim more money of maitenance. otherwise court will decided

Paying rent for the shop is proof of expenditure of business which would reduce profit.
You should cross him on his business margins
and then should ask him to produce invoices
of purchase,register of sales and purchase books,cash and stocks'book,his saving and current bank a/c transaction daily cash/credit sales and should suggest an annual net profit he earns.

In the given facts, it would be very difficult to prove income to the tune of Rs. 40-50000 PM. An intelligent cross examination can fetch results.

Expenditure is not an income. Income comes out only after making entire expenditures related with the business/job etc. Until positive evidence is not produced, the desired income of your husband cannot be computed.
