Husband contacted second marriage. He used to pay maintenance during his life time. After his death his second wife is getting family pension.

Weather the first wife can claim maintenance against 2nd wife who is drawing family pension of her husband.
Please clarify with authority.

One of the wife is getting family pension. where did he work, either in Govt or PSU? If government in which state or central. State or Central government employees shall file family particulars mainly wife/spouse, parents and children. so verify his service register to know whose name is mentioned as Wife. Refer pension Rules of the Government in which he worked.

Maintenance orders need to be referred, normally wife is not entitled for maintenance from family of divorced husband.
