Maintence expense

i want to know what happens if i delay in paying maintenance amt on time... i have lapse 2 court date... what would be my next step... if i dont have money...or what happens if i still dont pay by month..

Under which proceeding it was granted.If 125 Cr.P.C. then trouble may gradually lead up to arrest and jail progressively.

it is granted by local court.. my case is filed at sojat city rajasthan.. please tell me if i argue in court that we are proceding towards settlement with the opponent party.. will court grant me another date.. see i dont trust my lawyer and opponent lawyer.. they are asking for money unnecessary..

On default for paying maintenance allowance u/sec.125 Cr.P.C.,Court may issue Distress Warrant.

You can pay now.

But if you don't pay despite court starting distress measures, you could be arrested and imprisoned for one month.

Your BAHANA shall not work because if opposite party do not confirm your ongoing settlement meetings, no one is going to believe upon your words. You have no faith even in your lawyer why do you expect whole world should listen you and even trust in you?

see my opponent lawyer is saying me he will settle all things... but my lawyer is forcing me to pay maintenace amount... if i pay that now..my settlement figure will increase, means maintenace amt + my settlement.. i need time so pl advice me what shud i do... another thing i dont have any movable or immovable assest... so tell me arrest warrent will first be put or distress warrent.. i dnt have faith in lawyer in my case.. i am not giving bahana but think when u dnt have money what u will do in ur case.. i really dnt have money.. i use to do job and come from village background.. i am the only earning person in the family and that is also disturbed by this case..

If you fail to make payment then you would be sent to jail.
