Wife has on some minute argument gone to her home and not coming back since 25 days despite several efforts. is it right to file case unde section9A? what are the benefits of filing it?
Advocate Kappil Cchandna (Expert) 24 November 2014
Dear,

Ask her.to come and if she don't time RCR, its benefits are that she is bound to return if an order favourable is passed,

Kapil chandna adv, 9899011450
Devajyoti Barman (Expert) 25 November 2014
Once can always file case u/s 9 of RCR but before that try to settle the case amicably.
Legal recourse is never an option to survive a marriage.
ajay sethi (Expert) 25 November 2014
dont file RCR . once you do so she may file DV and other cases against you . try to settle issue amicably . meet her parents
Rajendra K Goyal (Expert) 25 November 2014
Once you file RCR which does not give desired results even if issued, you would be instigating her to file DV, 498A, maintenance and other cases against you. Reconciliation would be very difficult.

agree with experts.

""she is bound to return if an order favourable is passed,

Kapil chandna adv, 9899011450"

" SHE IS NOT BOUND.. SHE IS NOT ANIMAL..""

RCR IS USELESS, AS IT CANNOT BE EXECUTED
PL DON'T MISGUIDE...

& do not advertise or invite / no phone no. , unless querist ask for on PM
V R SHROFF (Expert) 25 November 2014
Shri Sethi & goyal advised prudently..

improve your std.
T. Kalaiselvan, Advocate (Expert) 27 November 2014
As rightly advised by experts, do not rush to initiate any legal action so soon, if it is just 25 days after she left, allow her to take some more rest say for another 5 months or so after which if personal attempts fail, you may send a legal notice asking her to return to your home. Don't dig your own grave now itself.
