Misbehavior

(Querist) 09 April 2010 This query is : Resolved 
Dear Friend,

can Shouting & misbehave (i.e. not giving respect, calling by their name etc) on Govt employees in side their office premises be treaded as criminal offense? Can it be initiate for criminal proceeding. If yes then what kind of punishment would be grant for that.

It would not amount to offence under law.

But it attracts disciplinary action against those misbehaving upon a complaint to the higher authorities by the affected person (employee).

These acts should have amply prescribed as Breach in the service conditions.

Though it purely a matter of disciplinary action, It may be an offence under 290 IPC for creating nuisance as his acts causing annoyance to other staff or public in office.
