Money handed over to freind.

Querist : Anonymous (Querist) 27 October 2010 This query is : Resolved
Dear All ..
I have given 20000 to a freind without any reciept or any security or any cheques.
Now he claims that he has refunded the amount to me .

Is there something I can do to get my money back???
Arvind Singh Chauhan (Expert) 27 October 2010
May be recovered on the basis of oral evidence of you or other witnesses before whom the money was given to him. But the burden is on you that for what purpose you gave the money to him.

You have to file a suit for recovery of money but at the time of trial you have to prove in the court about such lending. The onus of proof is upon you.
Deepak Shenoy (Expert) 28 October 2010
Was there anyone present at the time time when you lent the money as witness ?

As suggested by Dev, you file a suit for recovery and you have to prove that you lent the money. Then the onus shifts on that person to prove that he has returned back.

Yes I agree.
