You may execute a MOU and get it registered too. For stamp duty consult a local lawyer.

MOU will have a legal validity if it registered. In your case you can have supplementary agreement/MOU among your brothers for the demarcation and entitlement of flats according to your individual shares and the same has to be registered to get legal title on your share. You can show your share individually in the returns for the Income tax filing. (OR)

You all can execute the Partition deed and the same has to be registered for all legal purposes.
