There's no ancestral property defined under Muslim personal law.
The property shall be inherited by the legal heirs surviving the deceased as per Muslim personal law of inheritance
T. Kalaiselvan, Advocate (Expert) 27 August 2024
The Muslim Personal Law (Shariat) Application Act of 1937 governs the succession of Muslims in India. When a Muslim dies without a will, or if their will doesn't dispose of their entire estate, their heirs inherit the estate at the time of death
Muslim law of intestate succession divides a deceased's property among legal heirs, who are classified into two categories: sharers and residuaries. Sharers are entitled to a fixed portion of the estate, while residuaries receive the remaining portion. The shares of the heirs are determined based on specific rules and proportions outlined in Shariah.
Children and grandchildren (both sons and daughters) of the deceased are direct descendants and are entitled to specific shares. For example, a son is the first to get the residue, and daughters are entitled to half of the share as given to the son. If the son is not living, then the grandson is entitled to a share in the inheritance.
