adv. rajeev ( rajoo ) Online (Expert) 17 February 2010
when person dies before his father then theory of exclusion comes into play. In this case plaintiff's mother had died before her father, so as per the exclousion theory plaintiff wil not get share.

According to muslim law, if daughter is pre-deceased, no share goes in inheritance to her legal heirs in case of death of her father. So the plaintiff is not entitled to inherit any share in the given case.
