What if the Mumbai establishment does not or consistently maintain the muster roll with signature of employees to show they are present? What are the impact w.r.t damages and / or fine?

Immediately make a written complaint to your area Labour Inspactor working under Ministry of Labour & Employment Govt. of Maharashtra, He is bound to visit the premises complained and shall ensure the compliance of mandatory rules including the proper record of attendance of its all employees.riven

It is in the interest of employer that a muster roll should be maintained. However there are provisions in Shops and Establishment Act which is a state act and there should be one in Maharashtra as well, that employer is under statutory obligation to maintain muster rolls of employees. You csan lodge a complaint against the establishment with the labour department who will depute an Inspector to investigate and prosecute the employer.
