Non-Consideration of candidature against a higher post

I work in a CPSU and am a confirmed employee at E3 level. Recently the subject PSU has floated a direct recruitment notice for filling 01 post at E5 level in the same department, wherein the opening was allowed to be filled by candidates belonging from any sector (I. e. Private or Govt. Sector).

As per the recruitment rules, the method to be adopted for recruitment at E5 level is through promotion only and the highest level to which process of direct recruitment is prescribed at E4 level for 50% of the vacant position.

The subject PSU has not yet circulated the promotion policy applicable to its employee, as the PSU is newly formed and the 01st. Recruitment has happened in 2013-14 only.

Since the prescribed eligibility norms for candidates from Pvt. Sectors is also getting complied by me, prior to joining this CPSU.

Under the circumstances, please guide me whether the PSU should have first asessed about the availability of suitable candidates internally or not? Prior to going ahead with the process of Direct Recruitment or not?

Also what will be the outcome, if I apply for the same? & whether I should apply with the profile of only Pvt. Sector or apply with my current details, since only 01 application is permitted to be made by a single candidate and the eligibility requirement stipulates to have a pay scale of E4 level for preceding 02 Yrs. If applicant happens to be from Govt. Sector.

First of all ascertain, if the PSU has got the RRs modified or not.

Secondly, if the recruitment conddition is from E4 to E5, check if combined service of E3+E4 can make you qualified.

Rest depends upon supply of latest information asked above.

SUCH ACTION AS DESIRED BY YOU WILL BE ILLEGAL ON THE PART OF PSU AS THEY HAVE ADVERTISED THE POST FOR GENERAL PUBLIC AND CANNOT GIVE ANY PREFERENTIAL TREATMENT TO INTERNAL CANDIDATE.

NOT AT ALL UNDERSTOOD WHAT DO YOU REALLY MEAN.

IF YOU HAVE TO APPLY YOU HAVE TO APPLY AT PAR WITH ALL CANDIDATES AND HAVE TO PROVIDE DETAILS OF PRESENT EMPLOYMENT.

Hi Sudhir!
The RR of this PSU states that the first preference while filling any position is to be done by way of promotion and if any suitable candidate is not available internally, the process of Direct recruitment will get adopted thereafter. But the subject PSU had went ahead with the floating of direct recruitment notice as its first step, despite availability of suitable candidates internally.

The clarification is with regards to the response from Sh. Dhingra Sir.
1. Please be informed that the RR has n ot got modified by the subject PSU since it came in force w.e.f. 2012
2. As already stated, the subject recruitment has been kept open for all (I. E. For both Pvt. & Govt. Sector) & the only differentiation in terms of eligibility condition is preceding 02 Yrs. Experience should be either singly or in combination of:
(a) Pay Scale of E4 level in case of IDA or GP of 7600 in case of CDA
(b) Rs. 12 Lacs in case of Pvt. Sector
Thus for applicants from Govt. Sector the requirement condition is from E4 to E5
3. As regards to E3 + E4 combination, there is nothing specified in the RR. However, prior to joining this PSU approx. 02 year back, I fulfill the prescribed eligibility condition as a Pvt. Sector candidate as per the advertisement.
4. I would also like to inform you that the seniority rules as prescribed in the Service Rules of this PSU defines the procedure where "promotion to a grade are made from more than one grade".
