not present the complaianat due to unknown of whereabout the

hello all learned i would like to know as that inthe rape case the complainant is not present before the trial court since long ago how it is possible to complete the case without the testonmany of the victimn inform me the reason of the not present before the honcourt is that the compalaint was out of state residence thanks in advance

Here the case is that the complainant is absent and is not attending to court. In such case we have to ask the court to close her evidence and continue with the rest of the evidence. simply because the complainant is not produced by prosecution the accused will not be acquitted for that sole reason

Only because of absency of complainant is not over other witnesses be deposed with the permission of court.Medical report& medical officer & investigatig officer or other circumstancial evidence if there be proved.Only because of absency of complainant accused will not be acqitted.

See the complainant will definitely attend the court, when summons will be issued to her to depose before the court. In the criminal cases lodged with the police complainant is one of the witnesses and would remain present before the court when she would be issued to depose before the court as the witness.
