(Querist) 08 July 2009 This query is : Resolved
Dear Experts

My appointment letter says that " a clear notice of 3 months " and does not state any in lieu provisions.

I have resigned from my job and have asked for 1 months notice , and have also agreed to forfit my salary for the period and leaves .

The company is not willing to relieve me and is adament on 1 3 months notice , which of cource is not acceptable to me.

Please advise what options do I have.Pleas enote that I have already agreed to pay slalary in lieu of short served notice period.

Best Regards

Dear Girish,
As per your service agreement you should give 3 months notice in advance, or you should pay 3 months salary with benefits to the company, on such payment your company will relieve you from your services.

Thank you very much for the advise Mr Khaleel (please ignore No thanks gesture conveyed earlier , by mistake)

However please also advise is there a legal provision which could be cited to management , which makes them except salary with benifites in lieu of notice period , even if it is not part of the agreement.i.e agreement does not say any thing about it.

Best Regrds

Girish
