Occupancy certificate from authority

Builder have constructed 5 story building in GP.
TP had given permisiion for 4 floor.
Now resident wants to form society.
Occupancy certificate is required for society formation.
Plz guide how to get it?

Hello Adv. Bharat.

Since you are in Pune I presume you must be talking about some Gram Panchyat in Pune Dist.

I think you told you look at matter in NGT in Pune (National Green Tribunal is Opp. present Divisional Commissioner and Dist. Collector office Pune)

In same building but from different stair case go to 3rd or 4th Floor , Town Planning Dept of Dist. They sanction Plan for areas out of Pune Municipal Corporation , like Gram Panchyat etc. Ask them . All your problem they can solve

Move to consumer forum against builder for OC.

Generally the builder will refuse to obtain OC since this is not coming under PMC, but the society can issue a legal notice to the builder to procure the OC as mandated.
