A trial proceeds on issues framed and judgments are pronounced on issues,of course, some opinions may be expressed by court as obi tar dicta.

i am sorry to state that i misstyped the word obiter dicta, its counter part is Ratio Decidendi, the former is not binding while latter is.
"obiter dicta" is remark made in the judgement which was out side the scope of dispute and no court opinion was desired over that.

Issues are framed on the bsis of pleadings but in some matters, due to overlook or while appreciating the evidence, if it comes to the knowledge of the court that more issues are required to be framed upon which evidence is already on file then the same can be done and those framed issues can very well be discussed and conclusions may be got arrived.
