Passport issuance rejected due to 498 a case which is pending

Dear Experts,
That I am involved in 498 A Case pending before family court Peddapalli, Dist. Karimnagar, Telangan State and steps of compromise were taken up and paid a sum of Rs. 1,60,000 out of Rs. 200,000-00 and Rs. 40,000/- is to be remitted but due to paucity of funds not cleared.
I applied for passport and was not cleared by police due to pending of 498A case and can I make appeal to higher authority but who is higher officer, whether I can get passport or not during pendency of case.

You can apply before the local Magistrate to get an order so your foreign travel may not be restricted. On that basis the police would give you no objection.

Send letter to the concerned passport office.

You need to approach the court with the application to give the No Objection Certificate from the court to apply for the passport since the criminal case of 498a is pending against you. The passport authorities also knows about this mence and your declaration with the NOC from the court will allow them to issue the passport even if there is the rule under Passports Act. If the lower court rejects the application, you need to go to the Higher Court.
