Patenting of educational method and material

(Querist) 27 January 2014 This query is : Resolved
Thanks for all those who gave time to read my query and replied to the question. I would like to hire someone who can help me in getting this patenting process done. I would like to know the cost of this process and the fees charged by you (patent agents). Let me know the time it may take to complete this task.

Thanks

Hi,

I have developed a training program (material and method) IT IS NOT A SOFTWARE) The material and training method which i want to use is unique in India and in the world (i think). I want to patent my idea of training, the type material i developed and the method of training. Due to high competition in education and training sector, i am thinking that, as soon as i introduce the program, many will adopt my ideas (as i intend to take this program in complete India and in other countries) and competitors may change little or update it and start the same method. My training material and method of training can help lakhs and millions of people around the world in a particular field. But i want full credit of my development.

People having expertise in patenting may help me with their valuable answers.

Thanks

This involves technical issues of teaching which needs to be researched whether you are first one to come with this.
This does not mean you can not apply for this.
However during pendency of application if it is found that you have your won unique and distinct style not available so far you may get patent for this.
Visit the IP office of govt of India.

You may proceed to apply for patent by completing the required formalities. If found as per norms, it can be patented.

You can patent the training technique but not the training material, as training material falls within the scope of literary work for which you would need copyright under the Copyright Act, 1957(Act No. 14 of 1957) and Rules thereto, as amended from time to time, provided that the same is not plagiarised or already copyrighted by someone else.

The cost differs from person to person.
The time is not less than one year.

Idea and methods are not patentable.
They cannot be patented unless they are capable of being put to industrial application.
Check three things:
1. Is it invention
2. Is it new and non-obvious
3. Will it have industrial application

An expert in the Patent field may be consulted for further proceedings.
