Our company provides technical manpower to Organizations. The Organization(x) we were providing skilled manpower to has appointed another reputed company(y) and henceforth they will be dealing with us. We were previously paying PF & Esic for the workers. But now the y company insists that they will pay the pf esic and deduct from our payments.
Who is responsible for payment of statutory obligations
1. we- who are providing the manpower or y company?

The employer is bound to account for these and render advises to the Department.In this case,the employer is responsible for any default or shortcomings.

If the manpower supplied by you are being paid salary by you and are under your administrative control, you become the employer of such force and liable to meet the said statutory obligations.

Why do you want to refer the law when the fact is that you are the employer hence you need to meet the statutory obligations of the employees under you. However visit the labor laws in full wherein you will find whichever section that will explain your query in detail.
