Payment options for mutual divorce

(Querist) 08 February 2014 This query is : Resolved
Dear Experts,

Here I just want to know the difference or benefits of payment between demand draft and cheque for mutually agreed amount of settlement for mutual divorce.

1. Whether Courts have any objection to any of these options?
2. Which one is cheaper and better?

Regards,
Amit

why should courts object . it is between parties to decide about mode of payment .
Amit (Querist) 08 February 2014
Dear Mr. Sethi,

Please give me some insight on the better option as well.

demand draft is better . . cheque can bounce

DD IS BEST.

Cheque is cheaper but can be bounced hence not recommended option.

For DD exchange / commission (negligible aprox. Rs. 3.00 per thousand in SBI) has to be paid but once delivered purchaser can not stop its payment.

In my opinion, a cheque will always be better because, if things do not go well as planned, a stop payment instruction may be issued to the banker on the cheque being presented to them.
Rajendra K Goyal (Expert) 10 February 2014
Stopping payment of cheque issued would invite provisions of section 138 NIAct criminal proceedings.

The other party may not accept cheque easily.

Moreover, if the payment not stopped on the day of delivery of cheque, the chance may not be fruitful.

If the other party (beneficiary) is ready to accept cheque of future date, cheque is better.
