A Hindu male ABC who was a state government employee died on duty in 2009.(at his age of 58 yrs & 6 months).After his death,family pension for 7 years was sanctioned.ABC has wife and son in his family.Son is 22 yrs old.After ABC's death,ABC's family pension is being deposited in wife's pensioner account. Now,wife is not giving any single rupee from family pension amount to son.As family pension is getting deposited in wife's account,son is unable to withdraw money of family pension.Can son get share in family pension by filing a suit in a court?

pension is for benefit of deceased wife . son is 22 years old he should learn to stand on his feet and not dependent upon meagre amount which his mother gets

Son is major and has no claim on family pension in the given facts.

Permissible to widow of the deceased till her death or remarriage, whichever is earlier. Even after her death, the son would not be eligible for family pension after the age of 25 years.
Son should learn to take care of her mother after his father instead of keeping his greedy eyes on her family pension. He would see, mother would need old age care, not the money, even received as pension.
