Police is telling no fir on nonconzibale crime

Sir,

There is any provision that polce can not create FIR on Non-Conziable offence. If there is any rule then please tell me.

The provision of law is very clear. First of all I would like to differ and draw your attention regarding what is FIR. FIR means first information report not the case. Police is bound to revive the FIR. Now the point is what is the duty of the police after receiving a FIR which leads information regarding a non cognizable offense. The police has to send that FIR to the court with a prayer seeking permission of investigation of the case and if the courts like most time allows such prayer made by the police after having the courts approval can investigate to the case.
