i have a query about a land of 4000 sq ft that i had purchased around 2 years ago in the bijnaur area of district lucknow . Its a free hold land that was bought from a person who had power of attorney to sell the same . After few months of registry when i asked for Dakhil-Kharij , i came to know that its not possible because of boundation of power of attorney of that person . Now when i want to sell it , i am facing hurdles because of non occurrence of dakhil-kharij . Please let me the alternate ways to sell the land. Actually it is basically an agricultural land of a harijan farmer who gave power of attorney to a non harijan person who sold land to me . I came to know that in this case the new land owner , i.e. me has to be a harijan for being eligible for mutation other wise its not possible. What is the actual law ?

unfortunately you have victimized your self.A harijan has no right to sale unless permitted
in writing by the District Magistrate,hence he did not have authority to execute a POA for a sale.Therefore both the POA and your SALE DEED are VOID and you have no title to sale any person.if 3years are not passed sue the POA for damages or bear the losses.

i am myself a harijan sir . then what is my status then ?

then if the power of attorney is registered and valid you can go on.

POA is registered . As per documents it was made in the year 1999 between that harijan farmer and non harijan person.
