Dear Experts
I have filed a execution petition on behalf of company under specific power of attorney to represent their case before court, which was notarized, but court returned the case as that the power of attorney was not registered as indian registration amended act, 2012
Please clarify whether the power of attorney to represent case ought to be register or otherwise kindly provide judgments relating to same

1. Yes indeed such P.O.A. needs to be registered with the court's Registrar so as to enable you to represent as the legal representative of your company.

The POA should be registered in some cases and not notarized.

three types of documents must now be compulsorily registered within 30 days of the deals being executed. They are a power-of-attorney (POA) when it is used to execute a sale or any other transfer of property; agreements that involve a title deed being deposited as security for the repayment of a loan or any other existing or future debt; and a sale certificate when a property is acquired under any recovery law.

General power of attorney doesn’t convey any right or title,unless it is registered.

Dear Mr.Selva Kumar, you very well know that a POA deed need not be registered for representing before the court on behalf of the principal under order 3 rule 1 & 2, have you filed an IA to that effect under the said provisions of CPC, if yes, what is the disposal of the said IA? if the IA has been dismissed, you may take a revision on it. You dont need to quote settled law seeking to allow the said petition/affidavit when the provisions of law is very clear on the subject.
